Help with BWLegal and old credit debt

Hi, long story here. Had some personal debt due to losing income when credit crunch hit. Had a couple of defaults as a result.
5 years ago BW Legal threatened legal action and as I had just got out of hospital after a serious illness I tried to co-operate and organise something. They ignored several emails I sent and eventually I got court papers applying for a ccj.
I defended the claim and requested a lot of paperwork to validate their claim. The court sent something out confirming the request etc. and BW contacted me directly again requesting payment or they would proceed with the ccj. I asked what options where available and they sent a long list of options, however I noticed that each one involved me withdrawing my defence at court. I mentioned the requested paperwork and they said they would be sending as they would have to for the defence.
I heard nothing for 6 months until they sent a letter stating they were applying to get my defence stricken and proceed with the claim. I asked why and reiterated that I had been waiting on documents from them that they had not sent. They sent part documents that didn't really show what I asked which I emailed them stating.
Fast forward nearly 4 years and had heard nothing more until I got an email this week asking me to make payments etc.
In the last 4 years I have cleared all other debt and now have an excellent credit rating but am now worried what BW may do.

Can they try for a ccj again after not completing last time? Any and all help appreciated.

    Hi, all the old defaults no longer show on my file. Clear score has been clear for nearly a year and tried experian today and cannot see any of the old debt or defaults on there.

  • So the debt is over 6 years now then and statute barred

    It may not be, depending on when it was last acknowledged.

    OP - when did you last pay/discuss the debt with them?

    The last correspondence was 4 years and they initially started ccj proceedings 5 years ago so do not think the statute applies.

    If they issued a claim 5 years ago and did not proceed with it, it became stayed. I doubt they can apply to have the stayed lifted, they would need a very good reason for the court to say why not done anything for 5 years. You could issue a SB letter and see what reply you get. If they don't believe SB then you have got the proof of debt and required documentation for it to be enforceable. If they couldn't get this all before, I doubt they can now and so you have an unenforceable debt.
