Old overdraft debt

I had an account with a bank in 2006 which had an overdraft which I could not pay. I am in Scotland and after all these years as I out of country I have returned and my credit score is "good" with Exp erian but now i wanted to open an new bank account unfortunately my husband banks with same bank I had debt with he would like me to open account there. I have checked I have no Scottish decrees (ccj) against me. Do you think I should open account with different bank? Thanks in advance.
