Need help with APCOA parking charge
SarahLT
Hi, on 13/4/2018 I received a parking charge notice from APCOA for stopping to pick up a relative on route to the airport as they had decided to start walking on the 29/03/2018. The parking charge notice states it is for "the alleged contravention of dropping off or picking up outside designated areas". There are 4 photos which have amateur black text boxes on them stating "no GPS signal" and the date and time (total of 3 seconds between all 4 pictures). I have disputed with APCOA as they have not asked who the driver was, there's no clear signage else I would not have stopped there and the questionable "doctored" photos.
They have rejected my appeal with the following:
Thank you for your appeal received 18 April 2018 against the Parking Charge Notice issued by us to you on 29 March 2018
09:09. Having carefully considered the evidence provided by you, we must advise your appeal has been unsuccessful on
this occasion.
Your vehicle was observed parked in a non-designated area; the airport signage is put in place around the airport roads to
advise drivers they are not able to stop in these areas. Drivers are prohibited to stop, unload or park in non-designated
areas or red routes, which are clearly marked around the airport roads via signage and double red road markings. A vehicle
monitoring and enforcement operation is in place, with a charge of £100. Please note nobody is allowed to enter/exit the
vehicle in any circumstance on the airport roads or red route.
Please be aware that this notice is not issued under POFA 2012, and no reference to POFA 2012 is made within the
parking charge notice. The approach roads are situated on private land where terms and conditions apply at all times.
As your vehicle was parked in contravention of the terms and conditions of the site we are satisfied that the notice was
correctly issued in accordance with the BPA code of practice, and therefore not able to waiver the charge on this occasion.
Therefore you now have a number of options:
1. Pay the Parking Charge Notice at the discounted price of £50 within 14 days. Please note that after this time the
Parking Charge Notice will increase to £100.
You can pay by the following methods;
By Post Send a cheque or postal order crossed and made payable to APCOA Parking (UK) Ltd to:
APCOA PARKING,
PO BOX 222,
LOWTON WAY,
HELLABY
SHEFFIELD
S98 1NX
2. You have now reached the end of our internal appeals procedure. You now have the option to make an appeal to
POPLA - The Independant Appeals Service. You can do this within 28 days of this letter by completing the online
appeal form at ....... quoting the verification reference number *******. Please be advised that
if you opt for independent arbitration of your case, the Parking Charge Notice will be considered at the full amount of
£100. If you require a hard copy of the POPLA form please contact our customer service centre on 0345 301 1151
where one of our customer service agents will be happy to assist you.
By law we are also required to inform you that Ombudsman Services provides an
alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen
to participate in their alternative dispute resolution service. As such should you wish to appeal then you must do so to
POPLA, as explained above.
3. If you choose to do nothing, we will seek to recover the monies owed to us via our debt recovery procedures and may
proceed with Court action against you.
Yours Faithfully

bylaws apply at airports so no keeper liability
so your first task is to edit post #1 and remove any hint of who was driving, using the words , the DRIVER and the KEEPER only
next task is to name the airport concerned ? BM or Luton ?0 -
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas. You never know how far you can go until you go too far.0
