Amazon say they can't replace faulty baby monitor but will refund so I can re-buy it for £40 more!

The system certainly does give them the option to issue a replacement.

I had a hard drive failure two weeks ago. Purchased just before Christmas so outside the window of using the automated returns process.

Started a chat and they asked me if I wanted a refund or replacement. When I asked for replacement it was ordered there and then and arrived the next day. They also told me not to bother returning the dead drive.

Maybe they have different rules depending on the price of the original item.

I think part of it may be down to who actually sold it

Items that have been sold to me by Amazon that have been faulty have been replaced by them (and like you told to keep the faulty item) but items sold by third parties and fulfilled by Amazon have been returned and refunded

To the OP - As others have said they are acting within the law

Amazon can only provide a replacement if they are still offering the item for sale. If the item is out-of-stock or no longer available, clearly they cannot replace. It matters little if other sellers on Amazon still offer the product, since Amazon cannot somehow access that seller's stock!

This is the reason Amazon have offered a refund and (under pressure) an additional £10 voucher. Since they only have to refund (and nothing else) the extra £10 is very generous.

So why not accept the refund and buy it at the cheaper price in the meantime?

Because I know Amazon would have gotten a replacement to me by tomorrow and the cheaper place I've not bought from before so don't know their reliability. I have now though anyway. I managed to get a £20 voucher from them and I've ordered it elsewhere that works out the same as I paid originally and it'll be here tomorrow, so that's fine.

Also if their system has it with a different stock number now then the system sees it as a totally different item

I had this happen with a mouse. They still stocked it but under a different number so would only give a refund
