Wrong item delivered

I recently ordered a slow cooker from littlewoods and payed for it out of my account credit.
We tracked the order which said that a slow cooker had been loaded on to the van, however when the item arrived it was a strimmer but the attached delivery note said it was a slow cooker.
We contacted littlewoods who first insisted that it was up to ourselves to send it back, but as I explained that my husband was house bound and we don't have a car and my nearest collection point was a good 40 minute walk away they agreed to collect the item. We also reordered the slow cooker which by now had gone back up in price but they told us that when we received the slow cooker they would honour the price difference which they did.
They said it would be 10 working days for them to collect the strimmer and refund us the price we paid for the first slow cooker. It has been three weeks and no one has contacted us.
Can we keep the strimmer as technically they have charged our account for two slow cookers even though what we received was one slow cooker and a strimmer.
We haven't opened the strimmer it's still in the box with the return paperwork waiting to be collected.

Sure you can keep the strimmer,if you pay for it. Thats what you meant of course?

We have technically paid for the strimmer but at a reduced price. The slow cooker was 48.99 the strimmer is 99.99. They will not refund this payment until the strimmer is returned and we are still waiting for them to pick it up.

The strimmer is not yours .... yet.

You have to make it available for them to collect.

In "Ye Olden Days" it used to be that if you'd made something available for 6 months and it hadn't been collected, then it became yours - but the law may have changed in more recent years.

So ... there probably IS a date at some time when it becomes yours if you've made it available for collection .... but it's not going to be this side of the summer.

The simple answer is no, you cannot keep something you haven't paid for in full. They may decide that you can keep it if they deem that collecting it and refunding you is more trouble than it's worth but until then, you have their product and they have your money.

Looks like I will have to ring them again or we may just ask to pay the difference in price and keep the strimmer

Not so fast. Wait for it to come down in price and pay the smaller difference! :)

And if it goes up in price?

OP pick up the phone and ring them. Stop playing games.
