So a notice of intended court action has come through from DRP stating if the charge isn't paid up they're gonna recommend smart parking to take court action.

Is there a next step for this?
Is this a joke, or have you honestly never read this?

    https://forums.moneysavingexpert.com/discussion/5035663/read-this-before-you-start-a-new-thread-about-zzps-or-debt-recovery-plus

And have you also missed post #4 of the NEWBIES thread as well, and seem to actually think this letter is something to worry about, despite being here since April and assuring us you had read the NEWBIES thread and realised how you mucked up the appeal?

    Unbelievable. Is this for real?

Have you not already researched what the 'next steps' would be? It's all over the forum found by undertaking some very basic use of the forum search function. And they're trying to squeeze £100 out of you?

Did you not follow my advice given on 27/04/18 in post #4? I rarely repeat advice (I have a life to live), but my advice in post #4 hasn't changed. No more repeats!

    Wow!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

To all that have replied, yes I have read post #4.

I got back in touch because of the reply from before - "Just ignore them and their ridiculous demands. The only time you need to do anything is if you get a formal Letter Before Claim.

If you do then come back to this thread for further advice."

Because I thought this was the letter they were referring to. And my reason for asking if there's a next step to this is because the letter didn't have the same title as "Letter Before Claim" so I wasn't sure if this is the letter that I'm supposed to come back for advice for.

To be honest I thought I was being quite chilled about this, coming on here and asking for help rather than freaking out about it but it seems I'm giving out the impression that I actually am freaking out.

I apologise if I make others feel like they're repeating themselves, I just thought I'd ask for advice on top of reading all the posts, reading other forums in a same/similar situation and going a bit of googling.

That way lies madness unless an internet search brings you to the moneysavingexpert website.

File everything in a drawer for six years. If you move, tell the scammers and keep proof you have done so.

Ignore anything and everything you get unless it is real court papers from Smart Parking. Not DRP, not ZZPS. If something says, our clients DRP, or acting on behalf of DRP, it is not from Smart Parking. It is from a debt crawler.

You really need to read what has been written by the regulars here, not make up your own story.

Tell everyone you know about us. Tell them to come here if they get a PCN.

Please also help us by complaining to your MP about this unregulated scam. This is the only way to get it stopped.

  • So long story short... After all the debt recovery letters, Smart Parking decided to reissue me the PCN but back to it's original amount as a gesture of good will (even though I kept receiving debt recovery letters even after this), and also gave me a new POPLA code. So I appealed, being honest about my silly mistake but I was also honest about what lead me to accidentally park in the wrong spot (in winter darkness, no clear road signs, two ticket machines right next to each other). Smart Parking were adamant that I've bought a ticket from some other car park (quite a walk away from the one I was in) and not from the ticket machine just next to (couple of feet away) from the hotel's ticket machine.

But anyways... my POPLA appeal was SUCCESSFUL!
