Isn't it obvious, and you've been told more than once on this thread by others:
I've yet to have a chance to go back and talk to the car wash people,
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Hi, I also received a ticket in the same car park for using the car wash back in November 2018. I appealed via POPLA and this was rejected. I also went to speak to the people who manage the car wash and they told me that POPLA’s decision is binding and there is nothing they can do. I am still receiving letters demanding for payment. Did they cancel your ticket yet or have you paid up? Help would be appreciated.

I recently availed myself of a hand car wash service located at the back of a local car park.

A few days later I received a PCN, claiming the vehicle was parked in the car park, and "Payment was not made in accordance with terms displayed on signage".

The car was not parked at any point - it was driven straight to the car wash, sat in the queue (for ages) and then left again straight away.

I appealed on this basis but the appeal was unsurprisingly rejected.

So my question - is there any point in appealing to POPLA? Or should I just wait for the threatening letters to start coming?

    Many thanks.

Surely, if they took this to court, they would crash and burn, it would be the word of a fine upstanding citizen against that of a scammer.

Have you complained to your MP yet? On 18th March 2019 a Bill was enacted to curb the excesses of these private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.

That is not binding on the victim! Have you reported this entrapment to Trading Standards?

POPLA decisions are not binding on the motorist. Only a judge's decision is binding.

PoPLA's decision is not only not binding, it is open to the suspicion that it is flawed, ill researched, ill considered, and partial. So much so that the government are likely to disband it shortly, (see post number 34).

I did actually manage to get the car wash people to intervene and the ticket finally got cancelled. It took some persuading, because it was nearly 6 months after the original PCN was issued. But I finally managed to talk to the manager of the car wash. He asked me to give him a copy of the PCN, and about a week or two later I received notification that the PCN had been cancelled.

So I'm very surprised to hear that they're not prepared to do the same for you. He gave me the impression that I was far from the first customer he'd had to do this for.

Incidentally, when I used the car wash, back in March last year, there was no information about getting a Pay & Display ticket for users of the car wash. But I noticed when I went back to talk to them that the signage has now changed to say something to the effect that users of the car wash need to get a free short term ticket. Maybe since that's come into effect, they can't intervene any more?

    They certainly can.

If they could for you, they can for Yasmin01 if she speaks to the Manager.

Glad you got yours cancelled - what a scam.
