Is my solicitor right or wrong?

  • when our son bought his house last year, he was presented with a statement of account (which included the solicitor's fees) and basically was a breakdown of where the funds for the purchase was coming from together and how much they expected to receive from him personally.

From memory this was done literally a few days before exchange

In amongst the main part of the thread I saw this "she told me a couple of weeks ago the completion would happen a week after the exchange"

It is up to you when completion takes place or rather you and the other side to agree. A binding date is set at exchange so if you need longer to deal with booking leave not to mention removal vans why do you not say that completion is, say, two weeks after exchange.

I've bought 3 houses in my life, in North Yorkshire, Lincolnshire and West Wales and I've always been given the solicitors bill (fees) after I've completed.
  • Our solicitors sent us a letter with a full statement of account, showing where all the funds for the purchase were coming from, their fees, the cashback from the lender and what we were expected to transfer as deposit.

At the bottom of the page was the total we were required to pay - they wouldn't proceed to exchange until full fees and deposit were received, and to be honest I don't blame them. I'd want to see the payment of fees before committing to the exchange of contract too, as that is the point of no return.
