  • Hi, just one quick one to ask to complete my defence.

    In my membership, under Licensee's undertakings, 3.5 confirms 'the licensee agrees and undertakes:

    3.5 immediately to give the licensor details of the registration number(s) of the motor car(s) which will be parked on the designated car parking and the name(s) of the owner(s) of such motor car(s) and notify the licensor prior to any change in such details (as per application form). - I have checked the application form and there is no mentioned of having to notify them??

    I did not notify the claimant immediately that I had changed vehicles. My wife and I were in out/out of hospital in labour so updating my vehicle details was the last thing on my mind. Should I mention this in my defence at all?

    No need to add anything IMHO.

    I hope I've covered it by calling that hidden term in the small print an 'irrelevant' and previously not used term, that the Claimant has suddenly turned into an obligation with a risk of a fine (a fine that didn't happen before, the t&cs about registering vehicles were dormant, not used).
