Default amount incorrect

A default has been placed on my account a couple of years ago which I believe shouldn't have been. I have contested it and although the company involved believe the default is correct, they have admitted that the amount was incorrect and the amount owed is significantly less than they have stated. Before I continue to contest the reasons I believe it shouldn't have been applied, can anyone confirm whether applying a default for an incorrect amount can be considered as 'against the rules' and therefore invalid?

    Sue them for slander, deformation of character and emotional harm.

    That or just ask them to correct it as any information they provide credit agencies must be accurate. If you winge a lot, you may even get a token nominal sum in compensation. It must certainly does not invalidate the default on its own. They have a duty to record accurately and if the default is justifiable then it will stay.
  • I was hoping that it could have been quickly dealt with on a technicality - they admitted that the amount was incorrect and the credits had not been applied to the account as they had been. Therefore I couldn't see how they can penalise me for not paying an amount that they agree is not correct. It's old and not life or death and there are other factors as to why it should be removed.

    Complain to the three credit reference agencies that the amount is incorrect, they have a requirement to display accurate information. You will not lose the default but at least it will be accurate
  • Why do you believe the default shouldnt be there?

    Do you owe money and fell behind with payments?

    Do not worry about Gary Dexter, not everybody gets that this forum is supposed to be free of judgement and he can be horrible to other / new posters.
    Wait for the abuse he will give me now for standing up to him.....!!

    It was a simple question to establish the current situation.

    Insisiting someone complain to the highest level and seek compensation was a worse suggestion.....

    Mr Dexter. You are the most judgemental poster I have seen on these forums.
    People often post at their lowest and you regularly belittle them and speak down to them.
    You appear to take pleasure in others crisis and I don’t like that.

    I never said complain at the highest level, I said complain to credit reference agencies as the information they post must be accurate. That’s the correct advice if the OP has hit stalemate with the compan6 who placed the default which they admit is for the incorrect amount but haven’t changed it.

    As I said it's old and hasn't seemed to impact my credit facilities, I wouldn't have even known if I hadn't taken a free trial.
    It just interested me... Technically, how can a company penalise a client for not paying an amount that the company have admitted was not wholly due to them?

    Contact them directly or contact each of the CRA!!!8217;s directly and raise a query with them.

    They!!!8217;ll then contact the creditor for an update

    By defaulting you and reporting it to the CRAs as they have done.


    If you feel that you should never have been defaulted then write a letter explaining why you believe you were wrongly defaulted and wait for their response.

    If their response is unsatisfactory then take it to the ombudsman for that sector.
