Great news! POPLA accepted the appeal.
After reviewing the evidence provided by both parties, I am not satisfied that the driver at the time of the relevant parking event has been identified. A Parking Charge Notice (PCN) was issued to the keeper of the vehicle explaining that the driver was liable for the PCN. After reviewing the notice it has not been issued under PoFA 2012. As such the operator is seeking to hold the keeper liable as the driver. After considering the evidence, I am unable to confirm that the appellant is in fact the driver. As such, I must allow the appeal on the basis that the operator has failed to demonstrate that the appellant is the driver and therefore liable for the charge. As such I cannot confirm if the PCN has been issued correctly. Accordingly, the appeal must be allowed. I note the appellant has raised further grounds of appeal. However, I do not need to look at these as I have allowed the appeal.0 -
