Internal Works done without building regs. Please help!!

Hi Everyone,

We are in a position to buy our first home, after searching for almost 6 months, we did manage to find a property. But after the survey, lots of issues have come up. The chimney breasts are removed from all rooms and also the kitchen. Out of the 2 chimney stacks, one is slightly bent. The loft has been converted into 2 rooms. A bedroom has been converted to a family bathroom in the first floor. Now all these works have been done by previous owners without any building regs and completion certificate. the current owners are not willing to apply for retrospective permissions. We are highly confused and need your honest suggestions, whether we should proceed or pull back .

    I would start with establishing when the works were done, and if you really want the place get a structural engineer in to look specifically at the alterations to check if the house is structurally sound.

    All you can really do is have a proper building survey done which should identify any structural issues. How long ago was the work carried out? If it was a long time ago (pre-1980's) it could pre-date modern building regulations anyway and no approval would have been required.

    If you are getting a mortgage then your lender is likely to require an indemnity policy which covers legal costs if there is no building control approval work but is in practice completely pointless. You can ask your seller to cover this cost which they might not like but they will probably go ahead when they nderstand their house is unmortgageable without.

    My first house had had a ground floor chimney breast removed and wasn't signed off for building regs, so I used it knock the purchase price down. I then built pillars on the old chimney breast footings, which I used to put built in shelves into.

    You can get an indemnity insurance for works done without having had the requisite building control sign off which I don't think is very expensive and you could ask the sellers to pay for this.
