Rent arrears

I'm hoping I've put this on the right board, if not please accept my apologies.

My family and I live in private rented property, and over the last year have unfortunately had to move 3 times. 2 Properties ago (hope this makes sense) it was our decision to move as I had just had a baby and wanted to move closer to my mum. Anyway, we found a new property, and moved in, but when we asked to be released from the other contract they refused, so we ended up having to pay 2 lots of rent for 2 months I think. Anyway, this wasn't possible, and unfortunately we got into arrears with the property we moved from.

To cut a long story short the agency owner came around our house to collect the outstanding arrears, and I verbally agreed to a weekly payment plan, which simply we could not afford, however I felt I had to. Having tried to unsuccessfully keep up, we had to move again as the owner of the property wanted to move back in.

I have been posting cheques through the office door for the outstanding arrears we were paying, however, some of these have bounced as the amount was unrealistic.
Because we have moved again, they have since sent a letter to a family member who lived further down the road asking us or them to make contact with the office, they go on to detail in this letter the amount of debt, how many cheques have bounced, and the amount of costs they have added on also. They threaten court action, and also baliff action to recover the amount.

I am willing to pay this, and want to pay it asap, however, it is not financially possible. I need to speak to them to arrange a repayment plan which I can afford, so I can pay this off. I have been advised to do this in writing.

The one thing that has upset me the most is the fact they have given details of the debt in this letter, which I thought they were not allowed to give to a third party.

Am I right in thinking this? I want to pay the debt off, but at a rate I can afford, but if they start chasing family members, I really don't know what to do.

Any advice would be appreciated, I'm sorry for the rant, but I'm just at the end of my tether.

    I think this would be better asked on the Debt Free Wannabe board as they have lots of experience in sorting out this sort of thing.

    was this relative acting as your guarantor ? if so they are legally able to be given this information as they are responsible for your debt.
  • no, we have never had any guarantors. My relative is nothing to do with us financially. In fact I'm not even sure how they got his name and address as he has a different surname from me as I'm married.

    There are quite a few points in your letter which the people of DFW can help you out with.. although your debts are housing related, paying them back isn't really in the expertise of the people on this board.... don't worry about moving your thread, just start a new one on the DFW board and copy and paste your message text across.
