On the bright side they haven!!!8217;t screwed him on the interest rate.
Many years ago I was a car finance underwriter and cases such as this would have gone through automatically.
I can!!!8217;t see what the dealer or Toyota finance could have done.

I would suggest you get onto Toyota, as im not sure what help this forum can do, apart from saying what you have posted here in a letter/email.

This has been suggested have you done this yet?

I wish you the best, as others have said its erratic financial decisions is what caused loved ones to get some medical advice.

My nan was diagnosed with early onset dementia after some she agreed to a contract that she doesn't remember doing.

I can't see where Toyota has done anything wrong.

They are NOT allowed to discrimate against geriatrics so his age is irrelevant.

As far as they are concerned, a chap ordered a car, signed for it and drove it away.

You even say he drove it for a month following the purchase. If you are such a close and concerned family then surely you would have tried to return it the very next day.

That doctor's letter is clearly only written to appease the patient. He is only repeating that the patient reports forgetfulness and dizziness. There is no medical opinion or evidence which supports this. Indeed, the doctor hasn't even outlined any follow up investigations / treatment other than 'keep taking the tablets'.

This just smacks of buyer's regret where you are now trying to find a get-out clause by trying to throw blame elsewhere.

Please stop the assertions that older people can't make informed decisions... or even impulsive decisions.... because of their age. That's just nonsense and you are making yourself look silly.

Your best bet is to stop blaming the company, approach them saying that your relative feels he cannot continue to drive and then minimise the financial impact of that decision by politely negotiating.

Some of the first signs that my late mother had dementia, were that she would trawl through the junk mail and sign up for their offers, whatever it was they were trying to sell, likewise if anyone knocked on the door trying to sell something, she would buy it, and again over the phone she`d do the same.

She would also swear night was day, black was white, she would of signed anything anyone asked of her, then deny all knowledge, her behavior became more child like the longer it went on, she only had state pension as income.

The signs are often there early on, i hope you sort this mess out.

But there's no evidence of early stage dementia... the doctor hasn't even felt it necessary to make any investigations,

Stress also can cause forgetfulness. Depression can lead someone to impulse purchases.

Old does not necessarily mean imentally incapacitated.

Plus, why did the family not act immediately? How is a salesman supposed to identify an issue if the family hadn't noticed?

  • The complaint will be with the agreement with the finance company to the finance company, contact citizens advice trading standards for advice & they will log it as a complaint if they agree & give you a reference number, if he is classed as vulnerable then the appropriate checks should have been done or at least advised your wife’s grandad to bring a family member who may have ATO or POA to protect grandad & also Toyota from putting a sale to a vulnerable person through.

How the heck would they know or even suspect him as being a 'vulnerable adult'... how would the family prove it anyway?

'Age' is now a protected characteristic... just being old does not make you vulnerable and I don't want to live in a society that assumes incapacity based on age... that's why the law exists.

Why should a salesman tell someone to go away and get a family member? Even the family doctor does not appear that convinced so how would a salesman be able to make that call?

Why was the car driven around for a month or so before deciding that he needs to get letters from the doctor and raise complaints about mis-selling. Was it a case he was happy driving it until the OP or someone has pointed out how long it will take to pay - is it a reduced cost plan where after X years he is expected to pay a lump sum to keep the car?
