NCD Issue
My husband was in an accident on 01/03 during the snow when a tanker drifted over into his lane, forcing him off the road.
This claim is still open as the tanker driver’s insurance has disputed liability so our insurers are taking it to court.
Our insurance was up for renewal on 17th April.
Our renewal documents from our insurers stated 1 year NCB, so that’s what we stated when taking out this year’s insurance.
I called on 17th April and asked for proof of NCD for our new insurer, and was told 3 years. This was sent to me in writing. I queried this and was told it was correct. I then forwarded this to my new insurers and they reduced my policy by around £280.
I’ve today been sent another NCD proof for one year. The insurer says it’s because when I phoned (at around 4pm on 17th) that my policy was still active and so at that time no claims was for the previous year.
My policy documents state the insurance runs from “Noon 17th April 2017 to 12:00 17th April 2018”. In my mind, that’s midday to midday.
They are claiming 12:00 is midnight. Even so, that would mean the policy ended prior to my phone call as the day ends at 11:59pm, but I’m being told no, that’s incorrect too.
Obviously, I’ve changed my policy based on the information they gave me, and received a discount as such.
Where do I stand with this? Obviously pretty peed off but unsure of my rights in this situation.

At the end of the day you have a claim outstanding so clearly you should know that your NCD would not have risen come renewal. Also, have you informed the new insurer about this claim?0

New insurer is fully aware of the outstanding claim, yes.
And the NCD did not go up, it stayed the same, so no bonus earned for this year. As I said, I queried it and was told it was correct. Even had the person on the phone look into my open claim etc. and re-confirm.0 -

Exactly my point. I called at 15:35 and was emailed across my NCD whilst on the phone.
I’m now being told my policy was still active, despite my documents saying my policy ended at 12:00, which would be midday.
They’ve said 12:00 is midnight, which a) is wrong and b) even if it was right, my policy would still have been over when I called at 15:35.0 -

However, if using a 24 hour format, 2400h is midnight and 0001 a minute after.
But after saying that my policies have always stated a start of 0001(i.e. a minute after midnight) on the day the new policy commences.

erm, no it isnt 23:59 goes to 00:00 not 24:000 -
When you have unprotected no claims bonus and a claim is made that your insurer pays out for then until the insurer is fully reimbursed the NCD is impacted
Your policy wording will confirm what happens with your insurer, but the norm is no NCD awarded for the year during which the claim is made, and you lose 2 years - so normally if you had 2 years NCD at the start of the year a single claim would mean nil NCD for the following year
If the claim is closed as being 100% the third party'sliability then your lost NCD should be reinstated0
