Ah ok, I wasn't sure about the evidence part. I am sure the judge said to send a defence to the court and the claimant, I wrongly thought it meant to include evidence as well.
Point 9 I found on a thread on this forum from November 2016 titled UKPC vs Resident - Taking me to court
