Has the PPC world gone mad?

Good Samaritan "fined" for being 1 second over, (no grace period!), appeal dismissed by POPLA:-

    Pity he paid the fine, I'd have loved to see that one go to small claims court. Proof, if needed that there is a race to the bottom between popla and IAS

    I suspect the POPLA appeal was weak and did not argue on Grace Periods. Just seems so wrong that POPLA don't check out a fairly clear case where Grace Periods are likely to apply and check with the PPC why they haven't so applied them. After all it is part of their CoP.

    Similarly POPLA should routinely check the NtK on behalf of the consumer for PoFA compliance where the PPC is pursuing keeper liability.

    The consumer is at a distinct disadvantage if they are naive about the technical/legal ins and outs of this game. Totally unfair.
