Pcn

Hi,

I was unable to find the answer in the newbies thread so any help appreciated:

My ex has use of a car owned through my ltd company (she is is still co-director) and parked in Lidl Stanmore car park and bought a ticket from the attendant, she was not advised it needed to be displayed and the attendant did not discuss this. She no longer has the ticket.

The PCN references no ticket displayed. They rejected the appeal originally. They have reached the end of the appeals process.

I contested this, but did not explain who was driving or admit responsibility. The car is in my name (but costed through the business) so a NTK was issued to my old address.

I now have a charge of £150 to pay within 14 days, increasing to £300, with debt collection agents already writing to the old address (not my new address - which they have also writtent to).

What should I do?

    Which parking company?

Based on what you wrote, it sounds like the Ltd company or your ex was the keeper at the time of the parking event

You look to be too late for further appeals and in the debt collectors stage - read up on this in the newbies faq thread near the top of the forum

You can ignore everything except a lbcca or court correspondence. They have 6 years to take legal action.

Come back for advice on how to defend this should it arise in the future

Throughout here you are advised never to reveal who was driving

You need to edit your OP to remove details of who was driving

Post one of the Newbies Sticky covers your situation fully - but Post four seems to be more applicable now.

£300 for a single ticket is ridiculous, Even if they took you to court and won, the most they would be likely to get is around £200, they are trying to scam you.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
You never know how far you can go until you go too far.
