Premier Parking Solutions PCN on private road?!

Hi,

I have read the newbies section and various sources so I think I know what I'm doing ish... just needing confirmation more than anything.

There is a private road directly outside townhouses/apartments of which the keeper of the car is a resident. On the private road there is space for parking (this is not ticketed or pay and display etc it is just a private road), however this space is limited so residents apply for a permit from the council to park in bays on public roads that surround the townhouses/apartments. The keeper of the car does have a permit to park on the surrounding roads too. However, the driver was returning to the residence on the private road after a time away and was unloading the vehicle with a lot of luggage. Following the emptying vehicle of all luggage, which was brought up to the residence, a Parking Charge Notice had been stuck to the window within minutes of the driver not returning to the vehicle. On the grounds that the keeper is a permanent resident on the private road and in addition the driver was unloading the vehicle at the time it is felt that the notice is unjust.

The notice shall be ignored and no payment will be made. Wait for NTK and then proceed from there?

Does this seem to be the right move and is there strong evidence (i mean the keeper and driver do live on the private road!) to overturn said notice?
