Sounds like the LandLords mortgage just went up and they are short of cash.
Bankruptcy isn't the worst that can happen to you. The worst that can happen is your forced to live the rest of your life in abject poverty trying to repay the debts.

Does your brother have a copy of the checkout report?

yes he does...thank goodness....and kept all letters from LL.....I would like to see LL produce the receipts after saying he has none...
  • Just a general comment - the replacement cost is the cost to replace like with like today.

It's no different with insurance - the fact that you only need to spend £200 today to replace something that cost you £800 six years ago is "just the way it is". Look at PCs, for example (or anything else where you get more, today, for less money).
    Warning ..... I'm a peri-menopausal axe-wielding maniac ;)
  • Just another point to add - make sure that landlord is not just saying they are raising a dispute in order to delay time and stop you putting in your court paper...

I would write to them and say you expect them to supply you with the dispute refernence number within say 14 days or you will file you court papers.

Ahhhh thats a point...thanks will do that, also does it matter that its the LL thats bringing up this dispute and not us....or if we don't hear anything back from him can we bring up the dispute with tds....thx
  • I don't think it matters who raises the dispute - as long as someone does!

I take it you deposit was put in one of the new schemes?? Ie your brothers tenancy started after 6th April 2007 - sorry I didn't pick up on this before - let us know if this is correct as it will change things slightly...

Did the landlord provide details of the deposit scheme used to hold your brothers bond?

No tenancy started before the 6th April 07, nothing was provided, can the tds still handle this, the EA have said they are sending the deposit to the tds, so it must be in some scheme....will check and get back to you thx....
