I’m looking for help.
I have just recently got my Ccj set aside by the county court as it was put on my records by mistake.
Hartwells finance issued it about 2 years ago but I only realised that I had a CCJ in October 2017. After months of talk with Hartwells Finance who have admitted it was their mistake and finally got the court to set it aside.
However, can I be looking at taking some action against Hartwells Finance for making this major mistake as it has not just caused unnecessary stress but more importantly affected my credit rating.
Any help or advice would be much appreciated, thanks.

Has it actually prevented you from doing something or can you prove a quantifiable loss or cost due to their error ?0

Sure sue them for slander and hope that a judge agrees with you.
It will be very expensive if you use a solicitor and you will not get legal aid for private law.
You could represent yourself (may I suggest you use a spell checker for anything you submit.)
If you lose, they will claim their costs from you, so your choice.
If that was me, write a formal complaint to them and accept a token payment if they agree with you. A token payment will be a nominal sum and nothing much.
To claim costs other than hurt feelings, you will need to quantify an actual loss.
Did you get turned down for a mortgage, loan etc (that you actually applied for) and did this cause you a cost or were you accepted at a higher APR? For example.
This admission of guilt from them, was it a full admission they made an error? Did you pay the set aside or did they? What was the error and how did it end up on your credit reports?0 -
Do you know for sure you would have gotten the loan if the CCJ wasn't there?
If you really must, then write a letter to the DCA lodging a formal complaint and see what they come back with.0
