I certainly do not have any knowledge of this, but my thoughts to an untrained eye is surely you can't sell it until a divorce arrangement has been agreed. ie He may have the right to have first dibs on buying you out as part of the agreement. Does he work, does he pay for kids, are you working or planning on returning to work. What do you think the house value will be if sold will your half be enough to buy a house or are you applying for social housing?

As much as you want to sell the house atm make sure you can legally first, I understand you may not want to stay with your parents but surely you need to know how you will fund a home for you and your kids in the future.

Housing benefits do not cover mortgages and I am sure I have been reading a lot of negativity regarding the other benefit being stopped that use to pay the interest on mortgages or help mortgage payments etc. Like I said I think you need to sit down and go through the motions and plan for the next year at least.

My a.hole of an ex is squatting there!! Literally!!!
So no me and the kids wouldn't be safe there. I don't want to be anywhere near him

If the house/mortgage are joint, then he's not squatting.
Not wanting to be anywhere near him is not the same as it not being safe. Do you have any reason to believe he may harm you or the children, as if so the advice may be different.
All shall be well, and all shall be well, and all manner of things shall be well.

Pedant alert - it's could have, not could of.

If the husband then had done the right thing in the first place and had the house and mortgage in his name only - would his wife be squatting if she moved back in?

Note to all - Danday regularly posts misleading information and I won't be responding to any more of his posts. I suggest others do the same.

I fully agree he posts misleading information. Over the past couple of weeks this has included contradictory stories about (amongst others) when he received PC and who owns the house he lives in.

And we'd all like to ignore him and not respond. Unfortunately, when he posts incorrect stuff in response to questions on this, and the disability, forum then there is a need to post to put things right so someone doesn't take the wrong course of action based on his advice.

If your ex-other half is on the mortgage it's as much his house as yours, and so he's not squatting.

To sell the house he will have to agree as well - even if he wasn't on the mortgage the time I sold a house any adult living in it had to agree that they would vacate on completion.

Selling to one of the 'we buy your house today' companies is likely to lose you approximately half of the value of the house. As an example, ten years ago I sold my house, it was a half diy done up terrace in a northern city, I was desperate to sell and couldn't do any more work on it. Three of the 'we'll buy it today' companies offered me less than 40K for the house, and although they advertised 'within 24 hours' their reality was 4-6 weeks to completion.

I put it on rightmove and had a sale agreed within 24 hours, completed in 5 weeks I think, for 80K. Looking at zoopla the other day none of the houses in that street - many of which were in a better state of repair than mine - have sold for more than mine did just after the crash in the housing market.

Don't throw your money away by selling it to an investment company.

I used the word "squatting" for the style and state he was living in. No offense but I'm not stupid!! Just someone who was depress for help.

're the investment company I've signed the paperwork. And I had a local estate agent out. I've done my calculations and they are actually offering a better deal. So they are worth talking too!

Sometimes wish I didn't post on these forums!!

Come back when they drop the price. Which they will. How do you think they make their money? By offering good deals to desperate people?

What is in it for the investment co to give you a better deal than you'll get on the open market? What are they going to do with it that will bring them a profit when they resell?

I'm with marliepanda on this, if it's too good to be true ...
