PCN notice has gone to my neighbour not me!

Firstly thanks for the huge amount of useful info here - I think I'm doing the right thing here but validation would be good ref course of action.

As a result of an error by the main dealer my new car was registered to my neighbours address around the corner (same road but v diff house number).

This has now been rectified and I have the new V5 doc.

Meanwhile I overstayed by 10 mins in a Waitrose Car Park leading to Britannia hitting me with their £40/£70 demand PCN

[my neighbour popped the unopened letters round to me]

I imagine the fist course of action is to write to Britannia stating that their info is wrong and that the car and named keeper do not and never have resided at said [incorrect address].

I was not proposing to add a senders detail to this letter merely state the facts as above and offer no help but asking that no further correspondence ref this matter be sent to the incorrect address.

Does that sound logical/correct?

I know that if Britannia do go back to DVLA they will get the correct info - in which case I'm clear on next steps should the PCN arrive at my address..

Hope that makes sense, any input welcomed.

    Well you need to advise Britannia of the new KEEPERS
    address. They cannot access your reg again from the
    DVLA for the same claim.

    These parking companies in general are pretty thick
    so you need to spell it out to them and request
    confirmation.
    Why ? because your neighbour could be harassed by
    these vermin as they continue their scam.
    Be aware that if it got to the stage it went to court and
    court papers arrived at your neighbours address,
    it may not be be passed on to you

    You can appeal to Brittania in the normal time frame

    As there is a grace period of 10 mins, you should get
    this cancelled by the MD of waitrose providing receipts

    First course of action is ALWAYS to let the retailer hear your wrath about this utter scam.

  • Thanks both, I should have added that I have followed this up with Waitrose at both branch and head office level and to my amazement they want [at this stage] nothing to do with this.

    I know - I was amazed but there you go!

    @Beamerguy - thanks for the additional info - I had not realised they (Britannia) cannot access DVLA for the same instance - but was not inclined to 'help' them out by confirming the KEEPERS address.

    I know my neighbour so will be speaking to her anyway as she's aware of this from the first V5 hiccup - I'd though that if Britannia got really heavy ref court proceedings etc they would be wasting their time as I do not live at the address they would serve any paper to?

    They would serve papers to last known address. If you don't get them and the case proceeds, they get a default judgement and you get a CCJ. Then you would be faced with the cost of trying to get a set aside and then the rerun of the case.

    Write some very bad things on Waitrose Facebook page and complain to you MP.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
    You never know how far you can go until you go too far.

    They wouldn't be wasting their time! As advised you could easily end up with a default ccj which you would have the hassle/cost of getting removed after discovering your credit files trashed!


    They have 6 years to take legal action - not beyond the bounds ofpossibility your neighgbour moves during that time!


    As advised give them your correct address - you have nothing to gain by subjecting your neighbour to having the aggravation of dealing with your mail/debt collectors letters etc

    As far as I know. Britannia don't do court, and they are easy to beat at PoPLA.

    So as advised, inform them that they have sent the NTK to the wrong address, give them the correct details, and appeal using the template from the NEWBIES.
    Make sure that you do not reveal the driver's identity. You are giving keeper details only, and appealing as keeper only.

    Meanwhile complain to your MP and Sir Greg Knight MP as advised by The Deep. Leave negative feedback on any and all Waitrose anti-social media, quoting the comments below that were used by MPs in open parliament about this unregulated scam.
