PCN From Civil Enforcement

I have received my first ever PCN and I don't know what to do. Please help.

I have dyslexia and this is my first ever post so please be easy on me.

Years ago I used to go to my local gym but then I stop and recently I wen't in for a quick inquiry and didn't realized they have the parking restrictions in placed. The car park is still free but one needs to register they vehicle reg for permit to park their car. The signs are confusing as one said permit holders only and the other authorized vehicle only but they change this one to strictly no parking as I notice on my recent visit but I got no proof they did this.

My inquiry should have took less then 5 minutes but due to wait at the reception it took 15 minutes and 12/13 day later I received the PCN. I did informed the leisure centre manger but they said they can't do anything. However I did used my card on that day which created a log showing on the system and got print-out to say I used the centre.

Due to my dyslexia and and first ever PCN I appeal to them in a simple way telling them what have happened and I wasn't aware of the parking procedure etc but they refused and now I need to appeal to POPLA.

Is there anything I can do as this was a guanine mistake or I'm I better off paying the £60 instead of £100. Is there any point appealing to POPLA? If I appeal to POPLA will Ce Service will tell them what I said in my first appeal just in case I say one thing to Ce Service and another to POLA. I have looked all over the net and look at NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? **READ THESE FAQS FIRST!** Thankyou! but I can't see any same case as mine. Any help will be appreciate. Thanks in advance.

    Of course it is worth appealing, it is a scam. Many judges regard not registering one's vrn as de minimus, i.e. a breach of contract so minor as not to merit any award for damages. However, PPCs think that they can make money from it so they issue tickets.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.

    Everyone is politely asked to read up on this in the Newbies FAQ thread near the top of the forum before starting a new thread - you say you have but have missed the bit about your circumstances being different! That doesn't matter!

    Before going there though edit your post to remove details of who was driving, assuming that you didn't tell them in your appeal

    Throughout here you are advised never to reveal who was driving

    The ppcs monitor this forum and can use your posts against you

    Well if you admitted to being the driver you will have to appeal to POPLA in the same way, but not using the same words you used first!

    The templates for POPLA are in the NEWBIES thread, third post. You can use at least two of them, copy those here and show us.

    BUT the first thing to do is COMPLAIN TO THE GYM MANAGER and get this cancelled, easily!

    I will go through Newbies FAQ thread again for more information. When appealing to Civil Enforcement they ask yes or no question first like if I was the driver or the keeper, to be honest I think I clicked I was the driver but on the appeal letter I put "we" instead of "I" and did said I was not the driver and that the driver remain with the vehicle whilst I popped into the center.

    I do have a habit of putting too many words on emails etc and don't know when to stop. Can someone please point me in the right directions as to what point can I use in POPLA appeal as I can't really see any. I mean ok it was honesty mistake by not put my VRN and not reading the parking sings due to the time I was going to stay on their car park it was only 15 mins but I have been in to leisure center on the day in question and I have the logs.

    Any suggesting points to put forward to POPLA appeal would be much appropriate. Ocne again thank you all.
