Am I legally entitled to payback £10,000 when a fraud was committed on my account?

Options
In 2002 I lost my wallet and told the bank 2 days later...someone during this time put 2 cheques into my account (for approx £5,500 each) and then withdrew the money the following morning before the cheques had cleared and before the banks had opened. I have been paying £10.00 for the past few years but am still very bitter at this. Am I responsible to pay all this money back? Does anyone know what rights I have?

  • Go and see a solicitor!

If you did not perpetrate this fraud then you are not responsible for the loss and should not have to pay the monies back. However, your acceptance (by agreeing to pay back at £10 weekly/monthly) might suggest you were responsible in some way. Without further details it's difficult to advise other than 'seek professional help'.

Why have you waited 5 years to do something about it? (5years*12 months*£10 = £600 paid. At that rate you have a long way to go, irrespective of any interest charges!)

Something is not right here and you need to give us the full story.

I assume that having withdrawn £10k, the cheques were then bounced - otherwise, no money would be missing.

On whose account were the cheques drawn and what attempt was made to trace this person?

Unusual that your bank allowed cash to be withdrawn against uncleared funds.

Unusual that your bank allowed such a substantial sum to be withdrawn in cash, anyway, without stringent checks.

Even more unusual that the money was withdrawn "before the banks opened" - how was it withdrawn? As an ATM would not dispense that amount of cash from any account in one day.

    Full story please ....

Later in the day, when fully compus mentis, you would have said 'Definitely a troll ...... 'cos none of it makes the remotest sense' 'can't happen .... didn't happen!' ;)

and we would all have agreed with you.
