Hi all,
The keeper received a parking ticket (Park Watch) via the post today and within the 14 day period, for over staying at the Arena Shopping Centre in Coventry. The parking duration was over the 2hr limit but under 3hrs by the time the driver had left the car park. However the driver had initially parked and began driving off under the 2hr period but then realised something had been forgotten. The driver was still in the car park at this point so re-parked the car in a different location and re-entered the shopping arena. This is backed up by the AA car genie installed on the car. Sadly the receipt cannot be found for goods purchased on the revisit and it was paid for using cash.
Based on the above, does the driver have good grounds to appeal?

not on the above info as they remained on site for longer than permitted
the KEEPER may have grounds for appeal , like no Landowner Authority , poor and inadequate signage etc

You always have grounds to appeal as keeper - your circs don't matter

And even if it was within 14 days, what about whether it has the POFA Schedule 4 paragraph 9(2)f warning right?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.
