Homezone parking elite management

Hi. A car was parked in this car park. The driver did not see the signs and was parked there for 10 minutes to go somewhere else. A parking charge was received and the standard letter from here was sent. That letter was rejected. Does the driver now need to pay the £100? Looking at the advice on here, should the driver ignore this letter? I have read through all the threads but got confused! Any help gratefully received.

What standard letter was sent, the one from the NEWBIES thread on this forum?

Post #3 of the NEWBIES thread tells you about POPLA (yes) and IAS (no, do NOT bother) and why/what to do. With an IPC it is clear there is NO NEXT STEP AND NO PAYING!! Can't get much clearer. Are they IPC?

No of course the driver shouldn't pay. Nowhere in the NEWBIES thread does it say that.

Please double check the exact name of the PPC as I can't find the one you have quoted on either the BPA or IPC AOS list.

Concentrate on the newbies faq thread

That takes you through the whole process from getting a ticket all the way to a court hearing

What to do after an initial appeal rejection is covered!

(The driver should not pay now! The advice here is never to reveal who was driving - is it too late for that advice?)
  • Thanks. The charge is from Elite Management who are BPA members apparently? The letter sent was the standard letter from the newbies thread.

And have you received a POPLA code?

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas
You never know how far you can go until you go too far.

Then you need to construct your appeal using all the template points available to you from post 3 of the NEWBIES, then post your draft here for checking before you submit it.

Was the PCN that was appealed, a windscreen one, and did the keeper ever receive a Notice to Keeper? I am pointing you in the right direction for your POPLA appeal, not expecting another question in your answer (please no asking why it matters).

We need to see your draft POPLA appeal like everyone else here does at this stage v a BPA member.
