Laptopsdirect - loss of a bargin

On the 20th Martch I brought a Samsung S7 and insurance off them. It would not connect to mobile phone providers. On the 3rd April, after return, they agreeded it was faulty, and they would replace it. Ten minutes later I found a message on their emessage sytem that they could not replace it as they didn't have any black ones in stock. I said I would have the Silver one. They said it was an extra £20.

Is this a loss of a bargin?

    It sounds like the phone wasn't fit for purpose, so the retailer was in breach of contract.

    So the retailer should put you back in the position that you would have been, if the breach had not occurred.

    In this case, that could be by giving you a replacement black phone, or it could be by giving you enough money back to buy a replacement black phone somewhere else.

    (Or you can mutually agree on another solution, like a silver phone for £20 more, or a silver phone at no extra charge.)

    Even if it was, not sure its worth taking them to court for £20 (i.e. what will you do if they won't provide the 'bargain' - is it worth pursuing)? Think you are going to have to be practical and get a refund and buy another phone or pay the extra money.
