Hi guys,
hopefully very quick one, I received a PCN and have seen your messages about replying with the stock response as the keeper but not the driver. I received this ticket a while back and have only just seen this thread but wondered what your advice would be regarding a PCN of 33 days old? Is the advice still to send the template as I still haven't received a NTK.
Thanks in advance for your help,
Dogfish

Try it anyway. The worst case is it will get rejected, but the scammers may still forget to send the NTK, which is the whole point of appealing a NTD just around the time they should be thinking about sending out the NTK.
Don't be surprised if the scammers do send the NTK in the next few days.
If they do then you are looking at a PoPLA appeal anyway, but possibly without non POFA compliant NTK as an appeal point.I married my cousin. I had to...I don't have a sister.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

Be wise about UKPC ???
They faked pictures, it was all over the national press
http://parking-prankster.blogspot.co.uk/search?q=ukpc
Currently on their website they say
"Within the parking industry there are some unscrupulous operators with untrained staff who have given the parking management industry a bad reputation and a poor image"
http://www.ukparkingcontrol.com/carpark-management
A very ODD statement considering that UKPC invented
the word "unscrupulous" in the parking industry with their
fakery and attempts of fraud
UNSCRUPULOUS UKPC .... think that's what they mean ??
Another Rupert wheeze .... fake news as well0 -
Unbelievable! The kneck this Operator has in making that statement. No shame whatsoever."Within the parking industry there are some unscrupulous operators with untrained staff who have given the parking management industry a bad reputation and a poor image"
http://www.ukparkingcontrol.com/carpark-managementPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

How long will it be before private parking firms are no longer a thing?
How dare they even call themselves an 'industry'? They do nothing whatsoever for Society.
Maybe it will take another 20 years for people to wake up and smell the coffee? OMG.
How long will retailers take to realise they are losing customers, how long will it take Managing Agents to realise they have a thug firm in, who are a threat and nuisance to their residents?
Come on, landowners/retailers, how difficult is it to spot?!!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

AH HA, it's an offer a management company cannot refuse,
Given UKPC want to scam residential spaces, the management
company can earn 10% by becoming traitors ??
UKPC SELF TICKETING

It's parking companies like UKPC that gets the BPA a
very bad name. When will the BPA wake up ?
Doubt they ever will whilst they still run a multi story
car park in the Gobi desert
