No heating, and carbon monoxide.. can anyone help !!

My gas boiler was condemed 2 weeks ago, after it was discovered that it was producing Carbon Monoxide... the yearly service was overdue by 6 MONTHS !!!!!!!


After a One week wait the new boiler arrived, and fitted , but the electricain had a problem with the thermostat, and couldnt complete the job...( even though the documentation was signed, to say the boiler had in fact been commissioned )


I have now been without heating for 2 weeks, an do not have a date, for the electrician to return , or for when the engineer will return to finish the installation .


I have been told that it is illegal to leave a tennant for more than 48 hours without heating or Hot water ( I do have a immersion heater )


Please can anyone tell me if this is true? ,and if not what is my legal position , ,Any help would be really apprecaiated :D Im at my wits end , fed up of chasing them , and getting no response .. just vague promises of a return call which they never make !!!

    There's definitely no law that says you MUST have heating, after all, you can rent places without any built in heating. Hot water might be a different thing as it would be a health & safety issue as you couldn't wash your hands properly without hot water, but the immersion would do that.

    However, if your LL allows the gas cert to run out and does nothing for 6 months, I'd get somewhere else if I were you.

    For now, a letter asking for a fix within 7 days, or an offer of a rent reduction. The value of the reduction is really a matter of negotiation, but asking for a lot might mean a quicker repair?

    I just wanted to say that my tennancy agreement says that GCH is included at the property .. so are they in breach please?

    Hello Mandi - where have you been? Can't help much on this one but there's another thread going at present with the same theme. Possibility of a rent reduction for the time without the heating, maybe?

    I wouldn't get too legal and contractual just yet ..... for example, does the contract guarantee or warrant that you'll have GCH 24/7? Just don't go there ;):D

    However, it would be unreasonable for you to be left without GCH as it's clearly included in the property and, arguably, "a benefit" included in the rent. 2 weeks is starting to push it just a bit far, so Real's advice is the best - a friendly, but firm, letter pointing out that you've now been without heating for 2 weeks and the weather can only be expected to get colder.

    I suspect they've all "moved on" to new jobs and you've simply been forgotten about - especially if the LL has paid the engineer and the electrician! :eek:

    Hope the one letter works :D
