POPLA Stages

Hello Forum Members,

I recently received a parking ticket in an ANPR car park from one of the larger and more presence-staking private car parking companies for overstaying my welcome by 30 minutes. I appealed the decision, copying the template from this forum and sending the appeal online.

The reply has returned, and it still offers me the £60 within 14 day’s charge. Should I pay it? It seems I have no leg to stand on, as I simply overstayed my welcome. I’m not very forum-friendly and i’m finding it rather difficult to find the information which is relevant to me and what the next stages of appeal are. Can anyone offer up some advice on my next approach?

    who was the parking Co , are they a member of the BPA?

    Legs on which you might stand include

    Do they have a contract with the landowner?

    Were the signs in the car park sufficient in size, position, wording, colour, and clarity to form a contract?

    did the signs have the proper council consents?

    Was their documentation compliant with POFA?

    and much much more. Pay if you wish, but it is a scam.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
    You never know how far you can go until you go too far.

    The advice throughout here is never reveal who was driving


    You need to edit your OP to remove details of who was driving. the ppcs monitor this forum and can use your posts against you


    The newbies faq thread guides you through the process after an initial rejection from the ppc


    Your OP mentions popla so assuming you are dealing with a BPA company follow the advice on preparing a popla appeal.

    How much larger than the minimum are the signs? How big was the lettering when you measured it? If they were above the sizes laid down you may indeed struggle (assuming you've checked the landowner contract properly).

    Or you could read the thread at the top of this board that tells Newbies to read it first for a winning POPLA appeal based on legal points.

    Ps is this related to your other thread that contained similar advice?

    If it's ParkingEye at a retail park complain to the retailer FIRST, before trying POPLA.

    Assuming you have a PoPLA code, copy and paste All the relevant PoPLA template appeal points from post 3 of the NEWBIES. Post it here for checking before you submit it.

    Do not pay, do not reveal the driver's identity. Do not miss the PoPLA appeal deadlines.

    You still need to edit your original post to remove information about who did what. Only ever refer to The Driver and The Keeper.
