Welsh Water CCJ

I have just searched my Equifax credit file and have discovered that I have a default CCJ for £700 from Welsh water. This was first registered 12 months ago.
The water is in joint names with the Mrs.
Up until recently the Mrs was in charge of paying bills etc. For the last 2 years or so she has suffered with anxiety and depression and has not been at all well, she claims that we have not received any papers from the court I cant be 100% sire on this as alot of mail was hidden away or binned, one thing is for certain is that I did not receive any papers from the court.
Going forward I don't deny owing the money but I don't want to just pay the debt and then be stuck with the CCJ. Im looking to buy a house this year and having the CCJ means that will not be possible.
I rung Welsh water today and explained the situation and they were less than helpful.

Unless you have a valid reason and meet the requirements for a set aside, you are stuck with this CCJ for 6 years, paid or not.

You clearly owe the money, if things were so bad maybe it would of been best if you had dealt with all the bills yourself.

Given the fact you've received this CCJ, you'll only have limited time and a strict requirements to have it set aside.

I'd post on the Bankruptcy section, lots more people there will be more fuller on information.

Valid reasons for set aside do not usually include,you personally did not see notification even though it may or not have been delivered, or that your wife's mental health meant she hid/binned them so you did not see them*. If the correct address was supplied to the court, not really much hope - after all they usually send them out in normal post and don't need to show they were delivered.

Your wife's mental health may determine how Welsh Water treat her, since they should take that into consideration (though as joint defendants they could simply keep contacting you), but it doesn't stop the CCJ being there.

Unless there are other circumstances that may help a set aside, then maybe the best hope if to pay in full, so it shows as satisfied. The CCJ will affect you getting a mortgage, but won't stop you getting one, just won't get the same deal someone without one may get. A satisfied judgement looks better than an unsatisfied one. You may want to seek independent legal advise if you think there is justification for a set aside.


( * if welsh water were aware of your wife's mental health status before hand, that could be a possible consideration, but seek ILA)

I wonder if anyone can help.
I was living in a rented property with my ex partner back in 2012.
I moved out of the property in November 2014, this was my first time living on my own so I was unaware I had to notify the water company that I had moved out.
The water bill was in both of our names.
I went for a job interview about a year ago and they did a CCJ search on me.
I had no idea but it came back stating I had one registered from Welsh Water.
My ex partner stopped paying the bill as soon as I left the property and was receiving letters from them.
He was living at the property for the next 2 years.
I have contacted the company on lots of occasions to argue the fact I wasn't living there and my ex never informed me of the bill but they advised that it's basically tough and I have to pay.
I have now decided to put a formal complaint in as I have been speaking to people who have advised that I shouldn't be liable as both of our names were on the bill....
I did pay over £2000 of it as I need to get the CCJ off my credit file but I am now struggling and I don't see how it's fair for me to pay for someone else's water bill.
Hope someone can shed a bit of light.
I have tried reading through the Water Industry Act but I cannot make any sense out of it!
Should provide one for dummies I think!

The answer though - you should have informed them you moved out - both parties are responsible for bills that are jointly named.

No supplier is going to entertain any complaint that has already been decided by a court.

Are you asking if Welsh Water add fluoride to water?

If so, the answer is no.
