Former tenants asking for invoices from months ago.

    You should at least tell them that you have their agreement to the deduction in writing, and maybe provide them with a copy. They may be considering a Small Claims Court action against you, but they will find it difficult to win if you have written proof that they agreed to the deduction.

    When I leave my rental property, I will be extensively photographing and videoing it. All tenants should do this nowadays, since cameras are so ubiquitous now there's no excuse really.

    Yes you are required by law to provide an invoice for the works carried out which they have paid for. The fact you did it cash in hand is irrelevant and does not absolve you of your legal responsibilities no matter what was agreed because lets face it, you were avoiding paying VAT and now it's come back to bite you on the !!!.

    I suggest you get your friend to provide you with one a bit quick.

    Hope you don't give advice to your mates down the pub.

    Dear MSE,

    When I left my flat the landlord agreed to take an estimated amount from my deposit for repairs, because I wanted the money back quickly and he wasn't sure of what the cost would be.

    It's now been a couple of months and we haven't heard from him about the actual cost. I'm getting worried that we're going to get a big bill from him if it's more than he withheld. I signed to say it was only an estimated amount at the time.

    I wrote and asked for the invoice but have heard nothing.

    Do not reply at all. By engaging in correspondence, you are opening this up.

    The tenants have already accepted the deductions and had their deposit returned.

    If they do decide to take this to small claims, they will need to write to you first. At that time, you can point out that the court will not only throw their case out, but is likely to award costs to the landlord, notwithstanding the small claims track, on the basis of a vexatious claim.
