Hi
I am moving along with my ESA appeal, money at appeal rate been re-instated, also gathering my medical evidence. What I would like to ask is, it has been over 8 weeks since I heard from the courts that they had recieved my appeal, but in the meantime nothing from the DWP (is the onus on them to make sure they send me all the info they have on me) or do I need to chase them. If they do not send me anything what then.
Thank You.

The Tribunal Service has a back log of appeals atm, so there is likely to be a wait for your hearing (and the DWP evidence bundle). You may be looking at 6 months plus, but this varies by area.
As a rough guide you will get the evidence bundle around 2 months or so before the hearing date. This should give you ample time to submit your statement and evidence to the TS.
You can request the medical assessment report (PA4) independently of the evidence bundle, but you don't usually need to chase the DWP for the complete bundle.
The bundle comprises your ESA50 form (hopefully you have a copy of this), the medical assessment, and the DWP reasoning for their decision, it may (occasionally) include medical evidence sought by the DWP (an ESA113 form).
BTW: The Benefits & Work site has a useful guide to ESA appeals available to members. But membership is c. £20 pa.Alice Holt Forest situated some 4 miles south of Farnham forms the most northerly gateway to the South Downs National Park.0
