Buyer might not make entry date

    Normally the estate agent would confirm the buyer is proceedable, before you even engage a sol. I'd be well peeved with the EA.

    Either way it sounds like you have not Exchanged (Englnd) or completed Missives (Scotland), so there is no binding contract and no fixed 'entry date'.

    You can either be patient and wait for this buyer to get their act in place, or re-advertise and start again from scratch. Up to you.

    And this is my first time selling so I’m unsure what to do and I have 4 weeks until I move into my new property so need it settled by then.

    Yes it’s a large high street agent so they should know better.

    You can remarket whenever you like. It's (almost certainly) not going to happen on Thursday. You could have remarketed last week, or whenever the buyer stopped communicating. Chances are though that they just need a bit more time for whatever reason.

    Do you need the funds from the sale to complete your purchase?

    Yes.

    Frustratingly I’ve had my mortgage moved over and approved by the bank. The property I am buying is a good 30k more so yes I need my sale complete for my deposit.

    Yes they might need more time but they have not mentioned not making the entry date the buyers solicitor is blaming the purchaser for the delay that’s all that’s been said no actual reason..

    I'm confused, aren't the buyer and purchaser the same person?

    Estate agents don't qualify buyers in Scotland the same way they do in England because the buying process is different. If it is the buyer holding up the process then it's time your solicitor communicated to her solicitor that it's time to !!!! or get off the pot.

    Yes same person.

    Well I said to my solicitor today push it and say I will remarket if there’s no proof she has a mortgage. My solicitor doesn’t think she has a mortgage that’s the only reason he can think of for the delay.

    Surely the agent should not have allowed someone to buy who isn’t in a position to buy?

    You don't know that she's not in a position to buy. Buyers can't control how long it takes them to get a mortgage offer (which you can't apply for until you've agreed a price).

    If they said they wanted to wait I wouldn’t mind however if she misses the date surely she has to give a reason?

    I had offer accepted on house i’m Buying in the 3rd week of feb. We’re going to bank tomorrow to get mortgage offer and sign paperwork. None of this is my fault, it’s just how long the bank is taking. There could be a great deal of things which are delaying things a bit which are just life.

    I am curious as to why in this scenario you didn’t ask if you could have a short let from your own buyer and avoid moving into the interim? We’re buying a total wreck a way away, so will need to rent until the end of the school year and then it’s caravan time :)
    I’d have bloody loved it if a would-be landlord was buying because I wouldn’t have to move twice!!
