Scammed by Country Attire LTD

Hi

I ordered an expensive coat online last week for weekend delivery, the item was being sent by DPD South and as I live in a private block of flats I asked them to leave the item in the enclosed sheds behind a bin, as I was running late from shopping. I arrived minutes after the online tracker shows delivery and no parcels were there. I must have had 100’s of delivers left there in the past and as its enclosed and on a quiet road its very secure. The company I bought it from are not being helpful and they have raised a query with DPD and I have asked for evidence of the exact location of the delivery and photographic evidence of where it was left – which has yet to be provided to me despite them having requested.

What are my legal rights, as the tracker even shows me having signed it (which obviously isn’t the case and they haven’t provided me with a copy of this signature). Can I raise it with my bank it was paid via debit card? I know for certain the area they should have left it and location I live no one would have stolen it which I think they may argue. Also my postcode doesn’t always take you to my block hence I have asked to see photographic evidence. I have a feeling the driver could also have stolen it given DPD's reviews for my local branch, but couldn't prove so

  • Your legal rights are to have the goods ordered, although this is a bit muddied by having it delivered to a non-secure location.

    Courier sign pads often record the location so it should be easy enough to work out whats happened.

    Sounds like a courier issue, rather than what your title claims.

    So you've not been scammed by Country Attire.

    Give them chance to investigate with DPD. Their drivers do have GPS tracking.
  • thanks, they have been saying as I requested it to be in a safe location its now my responsibility, even though I highlighted all the above and they haven't given me any proof of drop (Picture + gps location) off which they claim takes 5 days.


    Just wondering what else I can do to recover this if they claim someone stole it as they are trying to.

    Which is not unreasonable at all.

    The retailer is being helpful. You're being very impatient.

    Just out of interest, have you checked your email to see if there is a link showing the picture? When I had a Christmas present delivered by DPD, I requested it be left in a safe place & they sent me a link showing 2 pictures - one of my house & the other of the parcel in my safe place.

    this is what they are trying to say and that once you select to leave in a safe place they are no longer liable (im sure the T+C cover them). However currently they haven't given me pictures and I doubt the pics will show the correct delivery address, as If it had been placed behind the bins where I said its wouldn't have been noticed, plus I live in a quiet safe area.

    I guess, though, if someone happens to be walking past the area when the courier puts the parcel in the safe place, they could go & get it...

  • If you arrange for DPD to deliver the parcel to a safe place, the T&Cs place you as responsible should something happen to the parcel. They always take a photo and have GPS tracking too.

    If you didn't want to be responsible for a missing parcel you should have either collected it from a depot or been in when they delivered. They do give an hour window when they will be there.

    If you didn't want to be responsible for a missing parcel you should have either collected it from a depot or been in when they delivered. They do give an hour window when they will be there.

    They also usually advise you the day before or on the day of delivery by email and give you the option of changing the delivery day.
