i`ll cut to the chase.ive been called up for a work capability assessment .the problem i have is,the last time i was sent and asked to fill in an ESA50 formwas well over two years ago,probably closer to 3 years.alot of the stuff on the form isnt relevant anymore.how can i have a fair assessment with an esa50 form that is so out of date?i dont feel comfortable being assessed on the strength of it.what should i do?

You should have been sent an ESA50 form this time too. Are you sure you haven't received it months ago and forgot? It can take months sometimes for an assessment once returning those forms. Easy to forget what you've returned. hi poppy ,thanks for the reply.i`m 100% sure ive not had the esa50 form sent to me any time within the last two years,thats how long its been since i won my tribunal.so they must be assessing my on the strength of a very old form.very worried0

It is very important that you ring the DWP and ask for an ESA50 form and complete it before you attend your WCA. You also need for extra time to complete it before an appointment with Maximus is given. This is particularly important since you had to appeal the original decision which Maximus will not know about.
Also ask the DWP to inform Maximus that you have an extension to complete the form and the appointment needs to be cancelled. Make sure you make a note of the date/time/person you spoke to.
Personally I would also telephone Maximus and inform them of what you have done (perhaps leave this for a couple of days -depending on the date of your WCA)
If all else fails then you can download the ESA form yourself and take it to the WCA with your evidence.
The DWP will be able to tell you when/if they have sent you the form. On what basis were you awarded ESA?
If it was because of mental health problems then they may have sent you the form - it didn't arrive and they have decided to go ahead with the WCA based on the last form. If this is the case, then you can either download a new form yourself, take your up to date evidence and a copy of your tribunal decision to the WCA.0 -

That was something that I assumed would be the case also with PIP. With my last review application I returned it with a copy of the points awarded by the decision maker following the previous assessment as well as a copy of the decision (points) from the revised decision.
Doing that gives the assessor the full history of the previous reassessment and subsequent decisions.0
