dla higher rate care to standard PIP effect on esa

please can anyone help me? I have been on higher rate care and mobility components of DLA since 2008. i was also on incapacity benefit before being transferred to the ESA support group. Because I had the higher rate care,This meant that my occupational pension was ignored as income in respect of esa and I was able to keep that too. now though, i have just been moved from dla to pip but only been awarded the standard rate of both. does anyone know whether this means im going to lose my esa?

When were you transferred to ESA?
If you were receiving IB prior to 6.4.01 then your occupational pension will not be counted for ESA purposes.
If you received the transitional protection after that date and got the occupational pension exemption purely because you were receiving high rate care DLA then the answer is ' I do not know' - sorry.

I have researched this question before and asked a benefits specialist but we could find nothing to suggest that no longer receiving high rate DLA but receiving standard daily living PIP would mean an end to the occupational pension exemption. The legislation seems silent on this point.
Hopefully you claimed IB before 6/4/2001 and it won't be a problem.

thanks for your reply, no, my IB only dates back to 2008. Like you, I've never managed to find anything at all about this. I've bee worrying about this possibility ever since pip was first announced. Now its a reality, facing about £600 per month loss. i'm definitely appealing the PIP, but worried sick !!!
