DLR Intervention Shaft devalues property

I purchased from a renowned property developer a riverside apartment in 2004. I specifically asked for a property with good views of the river Thames so that I would have one of the best properties in the apartment block. This was an off plan investment.
One off the selling points was the fact that the Docklands Light Railway was to be extending to Woolwich, I considered this a plus point.
The Sales representative recommended the solicitor used for the litigation.
I was horrified when after completion, Building commenced directly outside my apartment of an Intervention Shaft. (WHICH I WAS NOT TOLD ABOUT)
This monstrous building has already devalued my property a great deal.
Despite the property boom my property has actually gone down in three years. I am also unable to fix a mortgage on this property. All offers made to buy this apartment have not materialised due to negative reports from surveyors relating to the Shaft.
I have written the developer, complaining about this. However, they blame the solicitor (WHO THEY RECOMMENDED) for failing to reveal the information about the Shaft.
The solicitor is blaming the developer for misrepresentation.
I was just wondering if there are any others on here in the same situation or if anyone has any advice as to what I can do.

Did your solicitor do a planning search?
Why is the sol saying that the developer is liable for misrep? Was the developer asked specific questions relating to the DLR extension?Gone ... or have I?0 -
It should have shown up on your searches, if it was the subject of a planning application.
Whether the solicitor was recommended by the developer or not, you are the client and he is answerable to you for his advice.
Did you have a survey done? Your surveyor should have highlighted this to you, same as other buyer's surveyors seem to have done.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. I'm not sure this has anything to do with the developer - but I wonder why your solicitor has accused him of "misrepresentation"? :confusion: The developer presumably had nothing to do with the plans for extending the DLR.
Doubtless he would have know of the plan to extend the DLR, but you did too .... as did most of London, I guess.
What information did your solicitor give you at the time? Did the solicitor tell you of the plans to extend the DLR and suggest you "look into it" or did s/he say nothing at all or something else?Warning ..... I'm a peri-menopausal axe-wielding maniac0 -
The OP knew the DLR was going to be extended but not right outside his window!!
This is something which should have come up during the searches....
I would say it was the solicitors fault...I'm not surewhat recourse you would have whether you could get a refund of the search fees paid or an estimate of the value it has knocked off the price?
Incidentially did it not get picked up by the surveyor either?
BTW this apartment wasn't in the Thamesmeade development was it?0
