Urgent - Build Over Agreement

Please help, we are due to exchange tomorrow!

We are buying a property which has been extended over a public sewer. The extension sits on top of the sewer. The builder/owner applied for a build over agreement (which was granted) however, my solicitor is questioning whether the appendix conditions where met. The build over stated that the manhole must be relocated, which is has been. We also had a full drain survey to check the structural condition of the drains and they are all perfect.

We have a signed off building reg certificate and have a few of the in-between inspection papers from during construction. Would the build over conditions have been inspected at the time of the budding inspections? Would they have been issued a building reg completion certificate without the build over conditions being met?

The water company websites states:

For small sewers (160mm and smaller)
The fee covers:

!!!8226; Discussing and agreeing any design changes proposals
!!!8226; Working with your Local Authority within Building Regulations

!!!8226; Registering the agreement to build over or close to the

Same for planning permission conditions, would these have been signed off in order to gain the building reg certificate?

Same for planning conditions, our solicitor is requesting confirmation that the planning permissions where adhered to but again, we have the building reg completion certificate.

    As long as you have the building regs completion certificate then that!!!8217;s fine. We!!!8217;ve had to get a build over agreement for an extension on our house. The building inspector will not sign off the build unless the build over agreement is adhered to and inspected.

    Thank you both very much, this has caused stress beyond words.

    Are the build over works absolutely inspected by the building control officer? Again, we have the full building reg completion certificate from the council.
