PCN Issued to Blue badge holder
Bailey2010
Hi Guys. just wanted a little advice regarding a PCN issued by mail from Smart Parking.
I am a disabled driver and have been parking my car & displaying my blue badge clearly at a car park previously connected to the Co Op. The store car park until recently store closure was policed by parking attendants, & after 16 yrs of parking there i have never had an issue. Apparently in March 2018 Smart Parking have taken over the running of this car park which is now monitored by CCTV. On the 06/03/2018 i used the car park as i have done on numerous occasions only to be issued a PCN.
i was horrified with the fine of £100. Unfortunately i have contacted them by phone ( mistake No 1) assuming that they weren't aware of my disabled status. Only to be informed that they didn't allow concessions for disabled drivers, I was informed that i could appeal and after reading some of the posts i'm not sure what to do, Should i appeal or just ignore the fine.
My apologies if this is repeated advice that i am asking of you but i don't really do a massive amount of social media, emails etc.
any advice would be massively appreciated,

What was the issue, surely not an alleged overstay while shopping?
You can still appeal using the NEWBIES thread template. Forget the phone conversation.
And you MUST complain to the landowner/retailer about disability discrimination.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

it will actually be monitored by ANPR cameras, not CCTV
It is not a fine , its an invoice for perceived rule breaking
NEVER phone a parking company
a blue badge isnt valid as such on private land, read the blue booklet that came with the BB (I know because I have had a BB since they were orange and the booklets have never said you are covered on private property and they still don`t !!)
the EA2010 is what covers you and your vehicles on private property , the BB is merely an indicator that you are covered by the Equality Act 2010
in future, you should read the rules on the signs , which usually involve getting a ticket after inputting your VRM into a machine (and sometimes money too)
use the appeals template in the NEWBIES FAQ sticky thread near the top of this forum and add a note stating that
An occupant of the vehicle was a blue badge holder and the EA2010 will be used in any appeal or court case in the future
DO NOT reveal who was driving, to anyone
and complain to the landowner and get them to cancel it by mentioning the EA20100 -
i have to admit that i'm not sure if i mentioned that i was the driver of the vehicle during our conversation, (mistake No 2) maybe.

Yes but that's not in writing, so start again as you mean to go on. Smart are EASY to beat!!

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas. You never know how far you can go until you go too far.0
