What I would like to know is should Abbey National have been able to put my name on the bank account even though we were jointly accountable for the overdraft? I can't remember having signed any documents when Santander took over Abbey National, so should I be made to pay all the debt?
I'm sure this isn't what you want to hear, but Abbey gave you two options:
1. Keep the joint account running, with you each jointly and severally liable for the debt.
2. Convert the account to a sole account, with that person then becoming solely liable for the debt.
You chose the second option. Indeed, at the time you wanted the second option. You would have been presented with paperwork to read and sign at the time so would have known, or should have known, what you were agreeing to.0 -
