Gladstone Solicitors letter received please help

    only if the DRIVER has not been identified , because they would have failed POFA2012 and so the keeper is not liable
  • Thank you Redx yes I have not identified myself as the driver so do I just have to keep this up in court? Can I appeal again or is it just too late now I have a letter from Gladstones?

    Another thing I would just like to mention is something that I didn't realise until now is that my Notice to Keepers were all sent 15 days or more after the 'offence' I know I should have realised this earlier but I am dumb!! Can this help me in court ???

    Yes, ONLY if they were all postal NTKs, issued by virtue of photos from an ANPR camera (no PCN).

    Not if there were PCNs on the windscreen first, each time. If so, the deadline to issue a NTK is much longer and is as set out in para 8 of the POFA Schedule 4 (link is in the NEWBIEs thread where it says 'for those who want to dig deeper').

    It's only NCP, who never do court, as the time of me writing this.

    Gladstone Solicitors then sent me a letter saying I need to pay £640 within 14 days or I go to court. Well they sent this to my old address, even though I moved months ago. I only know about this as I know the person who still lives there. But anyway 640 is only the cost of 4 of the fines added up, not 6, so this is confusing as well. I could post the letter here but see I can't upload pictures?

    It has been over 14 days anyway as I mistakenly payed 'Private Parking Appeals' to 'help me' not realising that company is a massive scam. I know I'm a dumbo!

    its much too late to appeal

    all you need to deal with is either

    a formal LBC (a real one) from the PPC or their solicitors

    and/or

    an MCOL from Northampton CCBC

    until these are sent there is nothing to do except sit on your hands

    it will help you to read post #2 of the NEWBIES sticky thread and also read other threads on here that are about REAL lbc letters and real court cases , so you get up to speed

    research, that is what you should be doing, learn all about it , like we do and we have done over the years
  • Ok so I've just read the Pofa 2012 and seen this:

    (5)The relevant period for the purposes of sub-paragraph (4) is the period of 14 days beginning with the day after that on which the specified period of parking ended.

    So technically it is 15 days after the offense ? Guess some of the fines are valid :(

    the postal NTK must arrive by day 15 , where the day after the incident is day one

    this assumes no windscreen tickets were issued on incident day

    BTW, these are not "fines" , no private company can "fine" you

    they are invoices, nothing more (they are actually Parking Charge Notices)

    which idiot has told you that these are "fines" ?

    In September 2017 I think NCP were using the flawed wording suggesting (due to bad drafting) that if you appeal, the keeper liability doesn't apply!

    Search NCP and look for posts in September and October about that firm, you will read all about it.

    Apologies is that bad to say? I meant 'in date'

    And okay I have looked that up, and I also looked at my NTKs and they didn't mention anything about appealing.

  • I have literally just trolled through like 20 threads and done about 8 different searches and cannot find anything related to their flawed wording - I will carry on!!
