No P45 from previous employer?

Hey guys,

Been at my current job just over a month now, and due my pay this friday, which is currently on an emergency tax code ( 1150LX ). I've been trying for a little over 3 weeks to get in touch with my previous employer for my P45, he has so far blanked all my phone calls and has not responded to my texts. Sending him a copy in writing I feel would also not really have any effect as he is self employed so not a big company or anything.

My current company gave me a form to fill out, may have been a P46? I filled that out about 2 weeks ago but the accountant was still asking for my P45 and warned me that my tax code would be emergency for this month at least.

Where about's do I stand on this in terms of getting my tax code off emergency, I have a feeling it will be like getting blood out of a stone trying to get my P45.

    The tax year starts again on 1st April (edit sorry yes 6th April)

    New tax year starts on 6 April at that point unless HMRC advises otherwise your 1150L code will be adjusted to the new L code basic 1185L and will be used on a cumulative basis. If your correct tax code is 1150L at the moment then all sorted, if this is not your correct tax code HMRC should advise your employer of the correct code but best to chase them up if this does not happen.

    I've had a check on my tax code online through Gov website etc. I know that my current employer have sent a p46 starter off but wasn't sure if it would be worth waiting until after this pay to see if they change it for next month.

    Unless HMRC advise a different tax code your code of 1150L non-cumulative will be changed to 1185L cumulative for next tax year. Is your normal tax code at the moment 1150L if it is your tax code will be correct for next year if this happens, assuming nothing has changed with your new job eg taxable benefits etc.
    Without seeing any figures cannot say if tax position for this year is correct but again if your normal tax code is 1150L then probably the correct tax has been taken though there is a chance you are under or over taxed. If you want to give the full details this can be checked.
  • To be honest if your tax code with your previous employer was 1150L (on a cumulative basis) then one of two things is likely to happen.

    Use of the emergency tax code for your March payment by your new employer will result in the correct tax being deducted.

    Or you will owe some tax to HMRC (this is quite common when you change job going by the posts on the Cutting Tax board). This happens where both your old employer and new employer pay you in the same tax period i.e. month to 5 April 2018 in this instance.
