Lease car PCN for short time period

Hi,
I have read through the newbies thread and found the section relating to lease cars and the template letter to appeal from Edna.

Can I just check that my understanding is correct - I have received a PCN from parking eye which states on the back that it is a notice to hirer, stating that they have contacted the lease company which have provided my details ( and copy of signed hire agreement and statement of liablity) but no other documentation was enclosed with the 1 page notice.

Am I correct in thinking that this is the grounds for appeal,(in breach of POFA regs) and to be safe it is best to wait until shortly before the end of the appeal period to ensure no further documentation is forthcoming within the relevant period?

Is it worthwhile putting circumstances and reasons I believe that the charge is unreasonable (14 minutes between ANPR pictures) or just keep to the original letter template as this information will make no difference at this stage?

( I have also complained to the facility the car park is for requesting their intervention, but no reply as yet)

    You are right but I wouldn't wait too long, on a NTH you only have 21 days to appeal. Maybe do the appeal next week online, choosing 'hirer/lessee' on the dropdown menu.

    You could mention lack of Grace Period but be careful not to imply who was driving.

    A hirer has a slam dunk winning appeal point for POPLA, that only the PCN arrived and no enclosures, contrary to the POFA 13/14 of Sch4, about what a NTH must include. So that's your main point.

    After waiting a few days, the business I visited and complained to has emailed a reply saying "We can ask parking eye to cancel it for you on this occasion"

    I had not yet put in my appeal with parking eye.
    Would you take this email as authority that I do not need to take things further with parking eye, or would you still reccomend I put in an appeal but reference the email?

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.
    You never know how far you can go until you go too far.

    I would suggest that you continue with your plan and send your appeal to PE and add a line about that cancellation email.

    PE have been known to refuse a cancellation, so until they confirm the cancellation do not miss your appeal window.
