Ex living in jointly owned home

My ex and i separated in 2012. He still lives and pays all bills etc in a house jointly owned by both of us ( he refuses to sell )I am a carer for my mum and also claimed income support, this has now been stopped as they say I have assets of £16000. The decision is being reconsidered. Iam worried sick as the house i rent now is accumulating rent arrears.

    2) Exactly what have you done to split the marital assets - and force the sale of the property?

    3) What is the value of the property and what is the outstanding mortgage?

    If you have an undisputed joint ownership of the property and no efforts are being made to sell the property then it won't be disregarded as capital.

  • Thanks for reply. Yes we are divorced. He wants to continue to live there, I have no problem with that.I don't want anything from the house at all.Havent a clue how much the house is valued at or indeed what state of repair it is in. Approx £24000 left on morgage.

    The house sale should have been dealt with as part of the divorce.

    It doesn't matter what you want from the house - you own half of it and the DWP will treat you as having that amount in cash. You might be asked to pay back any income based benefits you've received since the split.

    You really need to get your ex to either sell or buy you out. I don't know how you go about doing that, maybe you can get a free half hour with a solicitor.
    Unless I say otherwise 'you' means the general you not you specifically.
  • He wont sell, ive tried and he cant buy me out. Can my name be removed from the deeds ? I don't have the funds to see a solicitor to get this sorted.

    Is the house owned as tenants in common or as joint tenants?

    You can get free advice from a solicitor. How about citizens advice bureau?
