i need some urgent help, In march i was taken to court by the council for rent arrears and a postsoned possession order was granted on the grounds that i paid my weekly rent plus an amount off of the arrears, well due to work drying up i was unable to keep up with repayments. in the last four weeks however we have paid 1350 off of the rent leaving us 700 owing we are going to clear that in the morning, on friday i received a letter from the council saying that they are going to go to court for an eviction notice if i do not move out. Can they do this if i have paid off the arrears stated in the court order? it says on the order that it will no longer be enforcable if all debt is satisfied. if I had carried on with the installments the debt would have been paid off in december. Please help I am at my wits end with worry.

Its probably a case of the left hand not knowing what the right hand is doing.
Phone them up in the morning and they should be able to sort this out.
If they do go to court, then you will need to go along to put your case. On the face of what you have said, the judge shuld throw out their case straight away and give them a mouthful for wasting the courts time, but you do need to go along to make sure your evidence is heard.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. If you are out of work, surely you are entitled to housing benefit?
It wont pay off the arrears, but it will pay your monthly/weekly rent?Bankruptcy isn't the worst that can happen to you. The worst that can happen is your forced to live the rest of your life in abject poverty trying to repay the debts.0
