Final letter before debt recovery or court action

Dear forum,

I have fallen foul of a PPC's antics for the second time. The first was many years ago when the advice was to ignore.
Therefore when I received a PCN from Armtrac in August 2017 I chose to ignore, not realising that the goalposts had moved so much.
I received a NTK letter in December 2017, again choosing to ignore.
Now a LBA has arrived, and I have spent many hours poring over what to do next, because despite the wealth of information, I'm not quite sure on the best way to proceed.

I have written to DVLA to find out whether they are within the 29 to 56 day window for requesting keeper information.
I can also see that the LBA is deficient in terms of Practice Direction.
Should I reply to them in the next 14 days therefore pointing out these deficiencies?
Please advise on the best course of action.

    You have more than 14 days and if they say not, they've breached the new 1st October PAP - if they are saying that court action can follow 'without further communication'.

    Search the forum for 'CEL immune 1st October' to find a letter suitable for a parking firm who have threatened court action with only 14 days notice. Obviously it will need adapting and editing, as your PPC is Armtrac, not CEL.

    This is an entirely unregulated industry which is scamming the public with inflated claims for alleged breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They nearly always lose, and have been reported to the regulatory authority by an M.P.

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.
    You never know how far you can go until you go too far.
