Hi to everyone
This is my first ever post, So be gentle with me.
My neighbour has just received a letter from the DWP, Stating that they need to look at her claim for ESA which she was transferred to from Incapacity Benefit.
They need to decide if she may be eligible for income related ESA from 04 May 2013.
If she is eligible she may be entitled to extra payments.
If the DWP did wrongly calculate my neighbours ESA would she be eligible to have payments backdated to when she was transferred from Incapacity Benefit to ESA on 04 May 2013?
My neighbour receives PIP at the highest rates for daily living and mobility, She does not have a partner and lives alone.

The simple answer is Yes she would be entitled to backpayment for that period. I know DWP introduced limits on how far SDP could be backdated, but this is different. It was a failure by DWP staff to carry out their duties.0

Any award of SDP would be paid from when they were awarded the disability benefit.0
