Claim Form Received - Parking Control Management

Hi Forumers,

Firstly thank you for everyone's help on other threads. I've given about an hour's worth of reading so am no expert but at least understand the process a bit better now!


In May last year, I parked temporarily on a "double red line" on private land being patrolled by "Parking Control Management". I remained in the vehicle whilst the passenger went into a nearby shop for 2-3 minutes.


A PCN was received via post (Via Company Car leasing) within 20 days asking for £100. I appealed via the IAS who rejected the appeal and I have now received a Claim Form. Following advice, I have already sent of my acknowledgement but yet to fill out my defence.


In my original email, I didn't put that much research into it so I hope that hasn't reduced my chances of winning at Court? Also logging back into the IAS website, it looks like I may have ticked a box which admits I was the driver as it says




"You reported that you were the driver and the registered keeper at the time the parking charge was issued.

You reported that you are being held liable for the parking charge. " .


During a Spring Clean up, I threw away all the old correspondence but have found a copy PCN on the IAS.


Is it still worth fighting my case to the court? They have 5 photos of my car and a photo of the sign being very close by and not obstructed in any way.

    This is an entirely unregulated industry which is scamming the public with inflated claims for alleged breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, PCM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They nearly always lose, and have been reported to the regulatory authority by an M.P.

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.
    You never know how far you can go until you go too far.

    Ouch! Sadly, you threw away a MAJOR defence point. As hirer/lessee you could not have been held liable, because PCM - like other PPCs - never send the right documents with the Notice to Hirer. Oh dear. The POFA is out the window...you are going to have to defend as driver.

    Copy another PCM/Gladstones defence, after doing the AOS the NEWBIES thread shows you.
